Rules, rights, and obligations for using the digital content and online resource management platforms offered by GestioneDigitale.
1. Definitions and Service Subject
These Terms and Conditions govern the use of the digital platforms and technological tools provided by GestioneDigitale ("the Provider") for data management, digital organization of information, and online resources ("the Service").
The Service consists of a suite of web-accessible software tools designed to support businesses in the secure storage, categorization, search, and sharing of content and data. Technological innovation is at the core of our offering, but specific results depend on the User's actual usage.
2. Rights and Obligations of the Parties
2.1 Provider's Obligations
The Provider undertakes to provide the Service with the required professional diligence, ensuring platform availability according to the technical standards indicated in the official documentation. It reserves the right to make improvements, updates, or technical modifications to the Service, communicating them with reasonable notice.
2.2 User's Obligations
The User undertakes to:
- Use the Service in compliance with applicable laws and not employ it for unlawful activities.
- Provide accurate information during registration and keep it updated.
- Ensure the security of their login credentials and be responsible for all activities conducted under their account.
- Not attempt to access unauthorized parts of the platform or compromise its security.
3. Intellectual Property and Data
The Provider holds all intellectual property rights related to the digital platform, software, interface, and underlying technology. The User is granted a limited, non-exclusive, and non-transferable license to use the Service according to these Terms.
The User retains full ownership of the data and content they upload or manage through the platform ("User Content"). They grant the Provider a necessary license to host, process, and transmit such Content solely for the purpose of delivering the Service.
4. Limitations of Liability
The Service is provided "as is" and "as available". The Provider provides no warranties of any kind, express or implied, regarding uninterrupted operation, completeness, accuracy, or suitability for a specific purpose.
To the maximum extent permitted by law, the Provider shall not be liable for indirect, consequential, incidental, or special damages, including lost profits or business interruptions, arising from the use or inability to use the Service.
The Provider's total liability to the User for any claim related to these Terms shall not exceed the amount paid by the User for the Service in the six months preceding the event giving rise to the claim.
5. Suspension and Termination
The Provider may temporarily suspend access to the Service for maintenance, security reasons, or suspected violation of these Terms. In case of a serious and unremedied violation, the Provider may terminate the contract by disabling the User's account.
The User may cease using the Service at any time. Upon termination, access to data will be disabled according to standard technical procedures. It is the User's responsibility to export their data before the expiration of the post-termination retention period indicated in the documentation.
